Unravelling Click to Cancel

November 12, 2024
What is Click to Cancel?

The Federal Trade Commission’s (FTC) “click to cancel” legislation in the fitness industry refers to regulations that aim to protect consumers by requiring clear and transparent cancellation processes for gym memberships or fitness services.

This legislation typically mandates that fitness facilities must provide consumers with the option to cancel their memberships easily and conveniently, often through a simple online “click to cancel” feature.

By implementing this legislation, fitness businesses are obligated to make cancellation procedures more accessible and user-friendly, ensuring that consumers can terminate their memberships without encountering difficulties or hidden fees.

The new rule is due to come into effect in around six months’ time. ClubReady’s branded member app, powered by myFitApp, is already fully compliant, and ClubReady currently offers some online cancellation options within the system. We are currently working on a solution for ClubReady to ensure all studios and centers are adhering to the new legislation.

What is Negative Option Marketing?

The click to cancel rule also addresses negative option marketing, an important aspect affecting gyms and subscription-based businesses.

Negative option marketing relates to scenarios where a customer’s lack of response is interpreted as acceptance of an offer, often leading to automatic renewals or charges following the conclusion of a free trial.

What does Click to Cancel Mean for Your Business?

The new rule will have a significant impact on how gyms and fitness centers manage membership models. But it’s not all doom and gloom. We’ve put together some tips on how to stay compliant and how ClubReady can support you with this.

1. Review and Update Your Membership Agreements

Ensure that your membership contracts clearly outline the terms of automatic renewals and the procedures for cancellation. Before collecting a member’s billing information, all disclosures should be presented in an understandable manner.

2. Leverage Technology

If members can easily sign up online or through an app, you should provide an equally convenient method for them to cancel their memberships. This could involve incorporating a “Cancel Membership” button or form on your website or app. ClubReady’s mobile member app, powered by myFitApp, does just this.

Streamlining the cancellation process to be quick and user-friendly without requiring a visit to the gym or a conversation with a staff member is important.

3. Ensure Informed Consent

Prior to charging members, it is crucial to ensure they agree to any negative option features, such as automatic renewals. This consent can be obtained through checkboxes or pop-ups that require members to acknowledge and accept the terms before proceeding.

4. Train Your Staff

Educate your team members on the updated regulations and equip them with the knowledge to handle cancellation requests efficiently. While offering incentives to retain a member is acceptable, it should be optional, and the cancellation process should not be prolonged if the member declines the offer.

5. Offer Flexibility

Provide flexible membership options, such as month-to-month plans or the ability to pause memberships temporarily (ClubReady can support with this with the ‘freeze’ option). Giving members control over their commitment can reduce the urge to cancel altogether.Your Content Goes Here
